우생학의 재림과 ‘정상/비정상’의 폭력 ― 가족계획사업과 장애인 강제불임수술 (소현숙)

본 논문에서는 1960~90년대 시행되었던 한국의 가족계획사업과 그 과정에서 나타난 장애인 강제불임수술 문제를 분석하였다. 한국정부는 가족계획의 실적을 높이기 위해 우생학에 기반한 모자보건법을 1973년 도입, 장애의 우려가 있을 경우 임신중절을 합법화 하였을 뿐만 아니라, 남녀 장애인들에게 불임수술을 강요할 수 있도록 법제화하였다. 특히 1975년 정심원에 수용중인 “정신박약” 및 “간질환자” 들에 대한 강제불임수술 시행 여부를 둘러싼 논란은 모자보건법이 현실화한 사건이었다. 보사부는 모자보건법에 의한 불임수술은 본인과 그 배우자는 물론 사회공익상 극히 바람직한 것이며, 유전질환자, 특히 정신병자를 미연에 방지함으로써 인간의 불행을 막는 것으로, 우생학적으로 정당하다고 주장했다. 그러나 이러한 정부측의 입장은 종교계와 인권단체, 그리고 신경정신과 의사들에 의해 비판되었다. 가톨릭 측이 “세상에는 우수한 자와 열등한 자가 함께 존재할 권리가 있다”며 우생학적 강제불임수술을 근본적으로 비판했다면, 대한신경정신의학회는 유전성 조사의 정확성을 의심하여 불임수술명령의 발동을 반대하였지만 우생학적 입장 자체를 부정한 것은 아니었다. 이처럼 사회적으로 커다란 논란을 낳았지만, 장애인에 대한 강제불임시술은 1990년대까지도 공공연하게 이루어졌다. 요컨대, 가족계획은 인구의 양 뿐만 아니라 질을 관리하려는 시도였고, “건전한” 자녀를 출산해야 한다는 목표는 ‘건전치 못할 것으로 예상되는 자녀’의 출산 억제로 귀결되었다. 1973년 모자보건법은 이 과정을 합법화하기 위한 것이었다. 1990년대 말 모자보건법의 개정으로 강제불임수술명령 조항은 삭제되었다. 그러나 국가가 법령을 통해 장애인불임수술을 강제해 온 역사는 한국사회에서 장애인불임수술이 사회적 관행으로 자리잡게 되는 계기가 되었을 뿐만 아니라, 오늘날 장애인의 임신과 출산에서의 자기결정권을 상상하는데 제약을 주는 부정적 유산으로 남아 있다.


In 1973, the Korean government introduced the Mother and Child Health Act, which effectively legalizes abortion, to improve the performance of family planning. Based on eugenics, this Act legalized abortion when there was a concern of disability, while forcing sterilization for patients with genetic diseases. In particular, the controversy over whether to carry out forced sterilization surgery for girls with mental disabilities in 1975 was a case that the Act became a reality. The government argued that such sterilizations are extremely desirable for the public interest, and are eugenically justified by preventing human misfortunes. This policy, however, was criticized by religious circles and neuropsychiatry doctors. While the Catholic community fundamentally criticized eugenics, saying that inferior people also have rights as human beings, the Korean Neuropsychiatric Association opposed the issuance of sterilization orders, questioning the accuracy of genetic research, but did not deny eugenics itself. Despite such a huge social controversy, the forced sterilization of the disabled was carried out openly until the 1990s. In sum, the family planning was an attempt to manage quality as well as the amount of the population, and the goal of giving birth to healthy children resulted in the childbirth suppression of the expected unhealthy children.
